While there are many myths about immigration law, there is one myth that popped into my head like a light bulb went off. This myth is very interesting to me because I have been practicing immigration law for over 10 years and I just came across this discrepancy regarding immigration law.

Have you noticed that immigration officials, including USCIS and even Immigration and Customs Enforcement (ICE, these are the people who make arrests!) go out of their way to make their “services” available to the general public? Have you tried? For example, most people know by now that uscis.gov has online forms available, and they even have a 1-800# where supposedly trained officers walk people through filling out their forms and answering questions. Let’s “help” answer the question. As for ICE, they recently changed their website as well, according to a recent news flash.
But the key here is that as a seasoned immigration attorney, I have seen that the only so-called immigration reform we see these days is through stricter immigration enforcement. In other words, immigration is arresting and deporting people at an alarming rate. In fact, TRAC, an agency that studies US federal statistics, is consistently reporting that immigration enforcement and immigration deportation are at an all-time high!
In this year of 2010 under the Obama administration, DHS is proud to announce that approximately 400,000 illegal aliens have been removed (i.e. deported) from the US. This number is surprisingly large, especially for previous years. in comparison.
OK, so what does this mean?
Well, like I said, it occurred to me that USCIS and ICE are spending millions of dollars to make it easier for the general public to access immigration forms. At the same time, the same government agencies are spending billions to deport and remove from America the very people they are accused of helping.
So what does this mean for you? This means that when you are deciding your or your loved ones’ fate in America, you need to be smarter than USCIS and ICE and consider the political climate we are in now. Money talks, as the saying goes. So why is the US government spending so much money on “improving” access and at the same time spending even more money deporting people?
The answer is simple and it is the great immigration myth of 2010. This is because the US government knows when a member of the general public applies to USCIS or, worse, participates in an interview without a presence at the USCIS doorstep. of an experienced and licensed attorney, that person has effectively waived all of their rights!!
Yes that is correct. That under our current immigration system, there are no protections for illegal immigrants who protest that they now need a lawyer. Even criminal defendants can testify, “I need a lawyer,” and require the officer to stop questioning. Well, this is not the case for immigrants. I know from experience because I have heard from individuals who have become my clients. He told me that when he himself has filed and been arrested or is being questioned by ICE or USCIS officers, there is no response to a “I want a lawyer” petition from government officials. The officer will continue to question, interrogate, and even threaten the person with dire consequences (deportation for all, children taken away by social services, etc.) to the person themselves or their family, even if The person requests a lawyer during that time.
So how do you avoid the great immigrant myth? Hire a trained and experienced immigration attorney from start to finish, as USCIS and ICE are not permitted to contact individuals directly who have an attorney on record. You need to outsmart immigration so you can secure yourself and your family’s future here in America
